Patent Protection Provisions in Timor Leste

Currently there is no legislation providing for the registration of Patents in Timor-Leste. Hence, it has become usual practice to publish Cautionary Notices in the Timor-Leste local press to alert third parties to a proprietor's rights.

Language
The preparation of each Cautionary Notice need to be in Portuguese.

The Cautionary Notice are published in the two below local widely-read newspapers:

GUIDE POST – Monthly newspaper written in English.
TIMOR POST- Daily newspaper publication in black and white

We will need the following information’s/documents for the publication of a Cautionary Notice for Patent in Timor Leste:
(i) identification elements of the patent owner,
(ii) address, 
(iii) nationality of inventor(s) and patent holder(s), 
(iv) title of patent, drawings, abstract, and 
(v) copy of patent registration in home country.

Deposit at the Patent Registrar
Please be also informed that, despite the Cautionary Notices, there is also available a provisional system for registering among the Ministry of Commerce and Industry.

However, we would like to advise you that this is a provisional system which basically works like a deposit of patents (already registered in other countries), since there is no legislation providing for the registration and protection in Timor-Leste as referred before. There is no time limit for the Ministry of Commerce and Industry to do the registration and for the moment there is no publication for the registry.

TRADEMARKS

Trademark Protection Provisions in Timor Leste

Currently there is no legislation providing for the registration of Trademarks in Timor-Leste. Hence, it has become usual practice to publish Cautionary Notices in the Timor-Leste local press to alert third parties to a proprietor's rights.

Trademarks: 
(i) identification elements of the trademark owner, 
(ii) graphic representation of the trademark, indicating the color’s used (in case of mixed and figurative trademark), and 
(iii) identification of the goods and services protected by the trademark. 

Provisions:
Please, be also informed that, despite the Cautionary Notices, there is also available a provisional system for registering among the Ministry of Commerce and Industry.

However, we would like to advise you that this is a provisional system which basically works like a deposit trademarks (already registered in other countries), since there is no legislation providing for the registration and protection in Timor-Leste as referred before. There is no time limit for the Ministry of Commerce and Industry to do the registration and for the moment there is no publication for the registry. There’s no official costs associated until now, since it isn’t an official registry.
