Registration Overview
Patents in Grenada are governed and filed in accordance with the Patents Act Cap. 227 (this act governs international patents) and the Registration of United Kingdom Patents ACT Cap. 283 (this Act governs United Kingdom Patents).
Should you be interested in filing an International Patent Application in Grenada, the following is required:
1) Authorisation of Agent – the format will be provided to you.
2) A declaration that the applicant is in possession of an invention which must be accompanied by either a provisional or a complete specification.
• A provisional specification must describe the nature of the invention, and be accompanied by drawings, if required.
• A complete specification must particularly describe and ascertain the nature of the invention and in what manner it is to be performed, and must be accompanied by drawings, if required.
• A specification, whether provisional or complete, must commence with the title and in case of a complete specification, must end with a distinct statement of the invention claimed.
Should you be interested in filing a United Kingdom Patent Application in Grenada, the following is required:
1) Authorisation of Agent – the format will be provided to you.
2) A certified copy of the specification or specifications (including drawings, if any) of the United Kingdom Patent.
3) Certification from the Comptroller-General of the United Kingdom Patent Office giving full particulars of the issue of the patent on such specification or specifications.

TRADEMARKS
Grenada Trademark Law
Trademarks in Grenada are governed and filed in accordance with the Trademarks Act No. 1 of 2012. The Act is regulated by Statutory Rule & Order No. 18 of 2012. According to the Act, a trademark is “any sign capable of being represented graphically, which is capable of distinguishing goods or services of one undertaking from those of other undertakings” (Section 2 (1), Trademark Act No.1 of 2012).
Length of registration process and period of validity in Grenada
The application process will include preparation of the relevant documents, filing at the Corporate Affairs and Intellectual Property Office of Grenada, advertising in the Government Gazette to ensure there is no opposition to the mark and issuing of the certificate of registration. The entire process is estimated at a length of approximately 4 ½ months. On the issue of a Certificate of Registration, a trademark is protected for a period of 10 years from the date of filing and can be renewed within 6 months of expiry of the validity period.
Official filing receipt
The official filing receipt can be obtained in 8 business days after the application is submitted.
Trademark Applications
Applications must be based on a United Kingdom trademark. Multi-class filing system and International Classification are used. Service classes are accepted.
1. Power of Attorney simply signed by the applicant.
2. Certified copy of the UK trademark registration upon which this application will be based.
Our law also allows for priority filing. If the applicant is seeking priority and the documents in support are not in English, notarised copies and translations are required to accompany the application.
The Trademarks Act allows for multi-class applications. The Act applies the International Classification of Goods and Services for the Purposes of Registration of Marks adopted by the Nice Agreement, as amended.
